This document establishes and regulates the rules of use of the website www.spirithoteles.com (hereinafter the “site”), and includes all pages and content owned by Segura Hostelería, S.A. accessed through the domain and its subdomains, as well as the general contracting conditions for online reservations. The use of the site attributes the user status and implies acceptance of all conditions included in this text. The user agrees to read it carefully each time they intend to use the site, as it may be modified without prior notice and without any limitation. The texts can always be reviewed by the user. When making online reservations, whether as a simple visitor or as a registered member, and/or following all the steps to purchase services through it, as well as your request; implies the full and unconditional adhesion of the user to each and every one of the general conditions published on the website.2. 3. Intellectual and industrial property.
The intellectual property rights of this site are owned by Segura Hostelería, S.A, or by third parties who have authorization. Likewise, all trademarks or distinctive signs contained on the site are protected by law. Unauthorized use of the information contained on the site, or the unauthorized total or partial reproduction, distribution, commercialization, or transformation of its contents, constitutes an infringement of Segura Hostelería, S.A.’s intellectual property rights. Damages caused to intellectual and industrial property rights may lead to the exercise of the legally corresponding actions and, if applicable, the responsibilities arising from such exercise.4. Diligent action of the Site owner, for the exclusion of liability.
The customer must assess the content, programs, information, and/or advice expressed on this site and make their own purchasing decisions. We want to reiterate that we will take all appropriate security measures, according to current technology, to prevent third parties from making fraudulent use of the website, but we cannot completely avoid the existence of certain risks. Likewise, we will ensure that our content is accurate and unambiguous, avoiding typographical errors that may exist in our offers or services. It is prohibited to use the site for purposes harmful to the assets or interests of Segura Hostelería, S.A or third parties, or in any other way overload, damage, or disable our networks, servers, and other computer equipment (hardware) or software products and applications; or those of third parties. If the user becomes aware that the linked sites refer to pages whose content or services are illegal, harmful, denigrating, violent, or contrary to morality; we would appreciate it if you let us know.6. Reservation procedure.
Reservations and responsibility.
Through the portal, consumers or users can make reservations. Our services are categorized, and the available information about their characteristics and price appears on the screen; along with one or more descriptive photographs. Before making the reservation, the user must check it and assess if it meets their needs. In addition, the user must be over 18 years of age, provide the necessary data, and accept the present Conditions.Reservation procedure
The customer must follow the screen instructions, filling in the fields until the agreed room and date appear, without any commitment to purchase. You can view the reservation or delete it. If you wish to continue with the reservation, you must select the room and click the “choose” button or a similar expression. You can add different complementary services. Later, you will be prompted to fill in your personal information, and after entering your credit card, to complete the reservation process, you must accept the Legal Notice and conditions, as well as the specific conditions specific to the chosen reservation format (the most prominent ones will be displayed in a dropdown) and click on the “Make the reservation” button. When a reservation is made, and once the payment is received and verified, we will confirm the acceptance of the reservation by email within a maximum period of 24 hours from the confirmation. At the time of making the reservation, the different payment and cancellation methods will be indicated, with further information provided in the reservation confirmation email. Through the website, you can pay by credit card, bank transfer, and cash when the reservation allows payment at the establishment and is not a prepaid reservation. The contract ends once you leave the establishment. The reservation is formalized when you arrive at the establishment. Guarantees and data will be retained for legal and/or commercial reasons, if you accepted or requested them. For any additional information about your reservation or billing, you can contact Customer Service, or at the address provided at the beginning of this text.7. Withdrawal.
You contract accommodation services for purposes other than serving as a residence, with a contract that specifies a date or specific period of execution, therefore, there is no right of withdrawal. This is regulated in article 103 letter i) of the Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users.8. User obligations.
Commercial use of trademarked services is expressly prohibited, without the express authorization of Segura Hostelería, S.A, or the owner of the Brand. The user agrees to pay the price of the product and to use it in accordance with the law and the present general conditions. The user agrees to maintain the confidentiality of their password and to notify us immediately if they suspect unauthorized use of their account or password access. In addition, they undertake not to use another person’s account, user, or password.9. Obligations of Segura Hostelería, S.A.
They undertake to provide the user with the necessary information regarding the services, and once the purchase has been made, to send a confirmation via email, confirming the receipt of the order placed and the payment confirmation. Likewise, an invoice will be prepared and provided to the consumer.10. Terms of use for users and responsibilities.
Overloading, damaging, or disabling the networks, servers, and other computer systems or software of the owner or third parties is prohibited; or for purposes harmful to their assets or interests. If you become aware that the hyperlinks refer to websites with illegal, harmful, denigrating, violent or contrary to morality content or services, we appreciate you contacting us. If you send us any information, you agree that it is truthful and does not violate the rights of third parties or current legality. You agree not to reproduce, distribute, transform, modify, or manipulate the content, or the technical protection devices or configuration of the Site. Nor should you use means other than those provided by us to obtain materials, information, or files included in the Site. You are responsible for the use you make of what you acquire on the Site, use it according to the instructions and recommendations provided. You will be responsible for any damages that may result from improper or incorrect use; unless we engage in gross negligence, fraud, or breach of our obligations. You always have the right to file claims you consider necessary. You will be responsible for your actions, specifically for:- All acts that contravene these general conditions, the law, morality, generally accepted customs, and/or public order.
- Any act you perform differently from what is stated in the instructions or guidelines on the operation and use of the product or service.
- The accuracy, correctness, validity, and timeliness of the data you provide in each of the forms requested on the website.
- Direct or indirect damages caused by any third party if the user disclosed, neglected, or in any way allowed a third party to know, for reasons attributable to the user, their personal data or did not implement adequate measures to protect them.
11. Power to deny the order.
Segura Hostelería, S.A reserves the right to exclude or not allow the reservation if it believes that it violates current regulations, general conditions, morality, generally accepted customs, public order; if it harms a third party, or if, due to reasons derived from the website’s own image and reputation, it considers it inappropriate. In this case, if payment has been made, a refund will be processed.12. Information and modification.
We comply with the duty of prior information, as we have presented this text to potential interested parties before contracting. The temporal validity of these conditions coincides with their exposure time, until the terms and conditions stipulated here are unilaterally modified in whole or in part, with the user being obliged to consult our General Contracting and specific Conditions each time they access our online store. Ongoing or already completed orders will be governed by the conditions and consumer regulations published at the time of contracting. If you are registered, you must accept the updated conditions before contracting again. If a clause is declared invalid, it will be considered null without affecting the rest of the conditions, and without diminishing the user’s ability to file any claims they consider appropriate.13. Assignment and subrogation.
We may contract service providers, and collaborate or transfer the formalized contracts to third parties, to carry out the provision of reserved services. If you reserve at the Spirit Hotel Benalmadena Beach hotel, your data will be transferred to Zariquiegui Hostelería S.L. in order to provide you with the service. If you reserve at our hotel in Portugal, Hotel Spirit Fonte Real, your data will be transferred to Hotelider actividades turísticas unipessoal LDA.14. Termination and resolution.
This contract will be terminated when both parties fulfill the obligations they committed to in it, or when it is terminated by one of them if one of the causes for termination occurs, or if the counterparty seriously breaches any of the obligations established in the contract.15. Applicable law, jurisdiction, and validity.
This Legal Notice and the General Contracting Conditions are established in the Spanish language, and are governed in each of its extremes by Spanish legislation. As a consumer, you are protected, and can claim or sue from your place of residence. Both parties submit, with express waiving to any other jurisdiction, to the Courts and Tribunals of Bilbao (Spain), in the following cases:- That the buying party has their residence outside the European Union, and in that country, there is no bilateral or multilateral agreement with Spain preventing the possibility of expressing submission to the jurisdiction;
- If it is a purchase made by a company acting within its business or professional activity.
16. Online Dispute Resolution.
According to Regulation (EU) 524/2013 on online dispute resolution in consumer matters (ODR – Online Dispute Resolution), we inform you that as a consumer, you have a procedure available to resolve various disputes arising from the online sale of goods and services in the EU. Online and Physical Check-In:
Once the reservation is made, you will be able to complete the Check-In process on our website at any time, and we will also send you a reminder message with a link to complete the check-in, where you will need to enter your identifying information. Once completed, you must present that documentation at the establishment for verification, with the physical check-in process being a quick verification of the entered data. Remember that it is mandatory to bring and show your ID card to stay, and your card for payments, as well as a photo of your signature, which can be scanned through the trackpad. The check-in time is from 14:00 hours, and the check-out time is at 12:00 hours, unless bookings made through the website allow for check-out until 15:00 hours, subject to availability. Access to the parking can be done at 14:00 hours and check-out must be done before 12:00 hours, or at 15:00 in the case of bookings made through our website, also subject to availability. Accessing or leaving the parking outside of these hours is subject to availability and could incur extra charges. We are not responsible for any damages caused to vehicles inside the parking, as well as to the access and exits to the same.Specific Terms and Conditions:
- Prices are quoted and will be charged in Euros, VAT included.
- These prices are subject to availability and may be modified if not booked now.
- Pets are allowed with a supplement indicated at booking. When checking in, it will be necessary to read and sign the rules for the pet’s stay and behavior at the establishment.
- Smoking is strictly prohibited in the rooms and common areas of the establishment. Please note that smoking in rooms and/or common areas incurs a charge of 100 euros for cleaning, to be paid during check-out or applied to the card used for payment.
- Please be informed that the accesses and common areas of the establishment are under video surveillance, managed by Segura Hostelería S.A., and you can exercise your data protection rights with them. For more information on the processing of your personal data, do not hesitate to contact us.
- Children are considered to be minors up to 11 years old, including those who turn 11 on the day of departure (if they turn 12 during the stay, they would not be considered children). Additionally, children aged 0-5 can stay for free if sharing a bed or using a crib (crib reservation upon request and subject to availability).
- The establishment is not responsible for belongings left in the room, nor for belongings left in cars parked in our parking.
- Please note that reservations for more than 4 rooms may be subject to special cancellation and payment policies.
- By making a reservation, you give express consent to Segura Hostelería S.A. / Spirit Hotel Gran Bilbao to use the card provided at the time of booking as a guarantee for payment in the future, or the card used to make the payment, in the following scenarios: late cancellation and subsequent charge if stipulated by the reserved rate, no-show at the establishment, possible damages to rooms or facilities, and outstanding charges related to the stay. If the person making the reservation is different from the one staying at the establishment and they wish for another credit card to cover these scenarios, please contact us; otherwise, the card used for booking or payment will be used.
- To cancel or modify your reservation, go to the ‘My Booking’ section at the bottom of the website or from the link provided in your booking confirmation. When a reservation is canceled online, you should receive a cancellation reference by email. Please keep this number as proof of cancellation.
Purchase of products in our online store
Purchase Procedure
Through the portal, consumers or users can purchase products. The customer must follow the on-screen instructions and add products to the cart, without any obligation to purchase. If you wish to proceed with the purchase, you must accept the purchase by clicking on the ‘Complete Purchase’ button, accepting the legal notice and conditions, as well as any specific conditions that may be included in the description of the specific item. Subsequently, if not provided beforehand, the customer will be asked for their personal information with asterisk-marked fields, which are mandatory for correct shipping. To complete the purchase process, click on the ‘Place Order’ button. The contract is concluded once the goods are delivered, although guarantees and data are kept for legal and commercial purposes if agreed upon. We are not liable for any other damages, whether direct, indirect, or of any other kind, nor for loss of profit that the buyer may have suffered due to problems arising from the sale and shipment of products. The price of products and services is defined in Euros and will be as stated on the corresponding pages of the site for each product, valid as long as they remain accessible on the website. Payment for the goods will be made by credit card. Applicable taxes are included in the product price. Shipping costs are included in the price, and the user must check and accept the shipping costs to their address before finalizing the order, as they vary depending on the size and weight of the product or the destination. In general, Segura Hostelería, S.A. will email a confirmation of payment receipt via email.Warranty
The warranty for products is three years from the date of receipt, as indicated on the corresponding courier service receipt that the user signs upon delivery. In the case of second-hand products, the warranty will be 1 year.Withdrawal
If you are not satisfied with the physical products purchased in our online store, you have the right to withdraw from the contract by returning your purchases, as indicated in the following paragraphs. The withdrawal period expires 14 calendar days from the day you or a third party designated by you, other than the carrier, received the goods for physical products. The right of withdrawal does not apply to the following items:- Goods made to the consumer’s specifications or clearly personalized.
- Goods that may deteriorate or expire quickly.
- Sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
- The provision of services, if the service has been fully performed.

Access to the closed parking lot has an additional cost and availability will be confirmed upon arrival at the hotel. Accessing/exiting the parking lot outside of these hours is also subject to availability and may incur extra charges. Access to the open-air parking lot is available to all customers, subject to availability. If the person making the reservation is different from the one staying at the establishment and they want another credit card to cover these scenarios, please contact us; otherwise, the card used for the reservation or payment will be used.

Accessing or leaving the parking outside of these hours is subject to availability and could incur extra charges. - The opening hours and dates of the pools, restaurants, bars, gym, game room, etc., are subject to change due to occupancy, season, hotel availability, and hotel operations.
- To cancel or modify your reservation, go to the “My Reservation” section located at the bottom of the website, or use the link provided in your booking confirmation. When the reservation is canceled online, you should receive a cancellation reference by email. Please keep this number as proof of cancellation.

SPIRIT APARTAMENTOS ATXURI
Online and Physical Check-In
Once the reservation is made, you can start the Check-in process from our website at any time, and we will also send you a reminder message with a link to complete the check-in, where you will need to enter your identifying information. After completing this process, you will need to present the documentation at the establishment for verification, with the physical check-in process being a quick check of the entered data. Please remember that it is mandatory to bring and show your ID to be able to stay, and your card for payments, as well as the photo of your signature, using the trackpad to scan it. The check-in time is from 15:00 to 21:00, and the checkout time is at 12:00, except for reservations made through the website, which can be extended until 13:00, subject to availability. If you wish to check in after 21:00, the client must complete both the payment and the pre-check-in. Please contact us at 633 31 46 09 for further information. Access to the parking lot is available from 15:00, and checkout must be done before 12:00. Accessing or leaving the parking lot outside these hours is subject to availability and may incur additional charges. - Pets are allowed in 1 Bedroom Standard Apartments and 2 Bedroom Standard Apartments with an additional fee indicated at the time of booking. When checking in, it will be necessary to read and sign the rules for pet stay and behavior at the establishment.
- Smoking is strictly prohibited in the apartments and common areas of the establishment. Smoking in the apartments and/or common areas incurs a cleaning fee of 100 euros to be paid during checkout or applied to the card used for booking payment.
- Please note that the access and common areas of the establishment are under video surveillance, managed by Segura Hostelería S.A. You have the right to exercise your data protection rights with Segura Hostelería S.A. For more information on the processing of your personal data, do not hesitate to contact us.
- Parking cannot be reserved in advance, and availability will be indicated upon arrival.
- Children aged 0-5 can stay for free if they share a bed or use a crib (crib reservation upon request and subject to availability).
- The establishment is not responsible for belongings left in the apartments or in cars parked in our parking lot.
- Special cancellation and payment policies may apply for reservations of more than 4 apartments.
- By making a reservation, you give explicit consent to Segura Hostelería S.A. to use the card provided during booking as a guarantee for future payments in the following scenarios: late cancellation and resulting charges as per the reserved rate conditions, no-show at the establishment, damages made in the apartments or facilities, and pending charges related to the stay. If the person making the reservation is different from the guest staying, and a different credit card needs to be used for these scenarios, please contact us; otherwise, the card used for booking or payment will be charged.
- To cancel or modify your reservation, go to the “My Reservation” section at the bottom of the website or use the link provided in your booking confirmation. When a reservation is canceled online, you should receive a cancellation reference by email. Please keep this number as proof of cancellation.

Online Check-In

Below are the policies of Spirit Apartamentos Valladolid Centro regarding the reservations made by users or clients, regardless of the channel they come from. These policies apply to all customers staying at Spirit Apartamentos Valladolid Centro.- Prices are quoted and will be charged in Euros, VAT included.
- These prices are subject to availability and may change if not booked now.
- You have made a reservation in a 100% online check-in establishment, so it is important to consider the following before your arrival. Booking one or more apartments implies reading these terms and conditions and accepting them.
- Check-out time is at 11:00 AM and check-in time is at 3:00 PM.
- Apartment cleaning is done for reservations of a minimum of 6 nights / 7 days. For reservations of less than 6 nights, cleaning of the apartment is not included. Cleaning will be done in the middle of your stay and includes towel and sheet changes. If you wish to hire additional cleanings, please contact us.
